§ 1. Definitions

  1. Portal – Online platform available at https://mojaopiekunka.pl, enabling the search for caregivers for children and seniors.
  2. User – An individual who is at least 18 years old and has full legal capacity, a legal entity, or an organizational unit using the Portal.
  3. Caregiver – An individual offering caregiving services, registered on the Portal.
  4. Account – An individual user profile created after registration.
  5. Service – The Portal’s functionalities, including searching for caregivers and providing their contact details.
  6. Payment – Fee for accessing a caregiver’s contact details.
  7. Geolocation – A function for matching caregivers based on the user’s location.
  8. GDPR – Regulation (EU) 2016/679 on the protection of personal data.

§ 2. General Provisions

  1. These Terms of Use define the rules for using the Portal, as well as the rights and obligations of Users and the Operator.
  2. Using the Portal implies acceptance of these Terms of Use and the Privacy Policy.
  3. The Portal operates in accordance with Polish law, in particular:
    • Act of July 18, 2002, on the provision of electronic services (consolidated text: Dz.U. 2020, item 344),
    • Civil Code (consolidated text: Dz.U. 2020, item 1740),
    • GDPR.
  4. The Operator may amend the Terms of Use, notifying Users 14 days in advance via email to office@imetroll.com.

§ 3. Account Creation

  1. Registration requires providing: first name, email address, password, and optionally a phone number and address. The address does not need to be complete; the town name and postal code are sufficient.
  2. The User is obliged to provide accurate information.
  3. After registration, the User activates the Account via a link sent by email.
  4. The User is responsible for the confidentiality of their login credentials.
  5. The Operator may verify the information and refuse registration if the data is inaccurate.

§ 4. Providing Address and Geolocation

  1. The User may provide an address or enable automatic geolocation to find caregivers nearby.
  2. Geolocation is voluntary and requires the User’s consent.
  3. Address data is processed in accordance with the Privacy Policy.
  4. The User may disable geolocation in the Account settings or on their device.
  5. The Caregiver consents to sharing contact details, such as a phone number or email address, with Users to facilitate communication.
  6. The Caregiver consents to the publication of their photo on the Portal, uploaded during Account creation.

§ 5. Searching for Caregivers

  1. The Portal enables searching for caregivers based on location, type of care, and qualifications.
  2. Caregivers’ contact details are provided after Payment.
  3. The Operator verifies caregivers’ profiles to the extent possible but does not guarantee their accuracy.
  4. The User uses caregivers’ data solely for establishing cooperation.

§ 6. Payments

  1. Providing a caregiver’s contact details requires Payment in accordance with the price list on the Portal.
  2. Payments are processed through a secure online system.
  3. Access to contact details is valid for 30 days from the Payment date.
  4. Payments are non-refundable, except in cases described in § 9.
  5. Invoices are issued upon request, with inquiries sent to office@imetroll.com.

§ 7. User Rights and Obligations

  1. The User is obliged to use the Portal in accordance with the law and these Terms of Use.
  2. The User has the right to search for caregivers, file complaints, block, or delete their Account.
  3. It is prohibited to violate the rights of the Operator, caregivers, or other Users.

§ 8. Operator Rights and Obligations

  1. The Operator ensures the Portal’s operation and data protection in accordance with GDPR.
  2. The Operator may restrict access, block, or delete an Account in case of violation of the Terms of Use.
  3. The Operator is not responsible for the User’s decisions regarding the selection of a caregiver.

§ 9. Complaints

  1. Complaints must be submitted to office@imetroll.com within 14 days.
  2. A complaint should include the User’s details and a description of the issue.
  3. The Operator processes complaints within 14 days.

§ 10. Account Blocking and Deletion

  1. The User may block their Account (temporarily suspend access) or delete it (permanently remove data) through Account settings or by contacting the Operator in accordance with the Privacy Policy.
  2. Blocking the Account suspends the use of Services, but the data remains stored until reactivation or deletion.
  3. Account deletion removes the User’s data, except for data required by law (e.g., billing).
  4. The Operator may block an Account for violating the Terms of Use, notifying the User via email to the address provided in the Account.

§ 11. Personal Data Protection

  1. The Data Controller is the Operator, contact: rodo@imetroll.com.
  2. Data is processed for the purpose of providing Services and billing.
  3. Details are provided in the Privacy Policy.
  4. The User has the right to access, rectify, delete their data, and file a complaint with the data protection authority.

§ 12. Liability

  1. The Operator is not liable for damages resulting from the actions of Users or caregivers.
  2. Liability towards non-consumers is limited to actual losses.

§ 13. Dispute Resolution

  1. Disputes are resolved amicably or by the court with jurisdiction at the Operator’s registered office.
  2. Consumers may use the ODR platform (http://ec.europa.eu/consumers/odr).

§ 14. Final Provisions

  1. These Terms of Use take effect upon publication on the Portal.
  2. Polish law applies to matters not regulated.
